ELAG® Business Terms

Prices:
All our prices are in EURO / € plus the German VAT and are valid with reservation till June 30, 2010 . All prices are ex our warehouse in Friedberg/Germany. Shipping cost for our appliances outside of Germany will be added.

Quotations:
All our quotations and offers are valid with reservation for 14 days after date of dispatch. We are not responsible for typographic errors or faulty transmission of data.

Orders:
All models can be ordered in mixed composition. An order is only considered to be accepted after our order confirmation has been processed. The confirmed prices and conditions are valid only within a timeframe of three (3) days after the calendar date as written on our order confirmation. If the customer has not objected within that timeframe our confirmed conditions apply as being accepted by the ordering party.

Service Parts & Accessories:
For service parts and accessories a minimum order size of € 25,00 applies. Service part and accessory prices are in general without shipping- and packaging cost. These will be charged in addition. In case of shipping by “Cash on delivery” an additional fee occurs. This fee can vary from country to country of destination.

Orders & Errors:
Orders will in general be processed in compliance with our present “Business Terms”. We are not responsible for printing errors in our documentations, pricelists, manuals, literatures or publications on our website. Data and dimensions are indications that may change due to manufacturing methods. Technical modifications are fundamentally reserved. Prices and conditions in confirmed orders are to be considered as being valid only for the single confirmed order.

Delivery time:
Deliveries will be processed within 10 days after our order confirmation was dispatched and only after pre-payment of our Proforma-Invoice was received, if this payment term was stipulated.

Payment conditions:
For new customer outside of Germany apply typically pre-payment by money transfer to our Bank account before shipment after our Proforma -invoice was received. Apart from that the payment conditions as written in our offer/quotation apply. Deductions and offsets on our invoices in any manner without our agreement are not permitted.

Claims for faulty shipments:
Apparent and visible defects must be claimed within 7 working days after shipment was received. ELAG will not be responsible for obvious transport damages. Such defects must be processed from the consignee directly at the concerning shipping company.

Reservation of proprietary rights:
All products remain our property till payment in full was received. After two reminders about unpaid amounts were sent to the defaulting customer ELAG Products GmbH reserves its right to retract the unpaid merchandise from the customer. In that case the customer permits the representatives of ELAG Products GmbH to enter his warehouse at any time during weekdays at normal working hours and will release the unpaid products. In case the customer claims for bankruptcy he will inform ELAG immediately and declare to the liquidator that the unpaid products belong to ELAG Products GmbH.

Venue:
For Europe the District Court in 61169 Friedberg/Germany is responsible. It applies German law.
